Privacy Policy - MedOp Assist

MedOp Assist™ ("Company," "we," "us," or "our") operates the MedOp Assist™ platform and any associated products, features, or services (collectively, the "Service").

This Privacy Policy ("Policy") describes how we collect, use, disclose, retain, and protect information about individuals who access or use the Service ("you," "your," or "User").

By creating an account, accessing, or using the Service in any way, you acknowledge that you have read, understood, and agree to be bound by this Policy. If you do not agree, you must immediately discontinue use of the Service.

This Policy is incorporated by reference into our Terms of Service. In the event of a conflict between this Policy and the Terms of Service, the Terms of Service shall control.

We reserve the right to modify the Service, its features, and our data practices at any time. This Policy is written to reflect our general privacy practices and will be updated when material changes occur.

We collect only what is reasonably necessary to provide and improve the Service.

3.3 Content You Submit

We process User Content as directed by you in order to provide the Service.

3.4 Payment Information

Payments are processed by certified third-party payment processors. We do not receive or store full payment card details. We may retain limited billing records for accounting, support, and legal compliance purposes.

If you contact us through any channel, we retain those communications to respond to your inquiry and to improve our support. 

4. How We Use Your Information

 We use the information we collect to:

  • Provide, operate, maintain, and improve the Service
  • Authenticate users and maintain account security
  • Process transactions and manage subscriptions
  • Respond to support requests and resolve issues
  • Send transactional and service-related communications
  • Detect, investigate, and prevent fraud, abuse, and security incidents
  • Comply with applicable legal and regulatory obligations
  • Enforce our Terms of Service and other agreements
  • Analyze usage in aggregated, anonymized form to improve the Service

We do not use your information for targeted advertising, behavioral profiling, or any purpose unrelated to operating and improving the Service.As the Service evolves and new features are introduced, we may process information for additional purposes consistent with this Policy. Where required by law, we will seek your consent before doing so. 

5. Automated and AI-Assisted Processing

The Service may use automated systems, algorithms, or artificial intelligence technologies to process information and assist users in completing tasks within the Service.

Any output produced by automated or AI-assisted processing is provided for assistive purposes only and does not constitute professional, legal, or expert advice of any kind. Users retain full professional, ethical, and legal responsibility for any decisions made or materials submitted based on such outputs.

We will not use the content you submit to the Service to train, develop, or improve automated systems or AI models without your explicit, separate, written consent.

The specific automated features offered by the Service may change over time. This section is intended to cover all current and future automated processing capabilities of the Service.

6. Disclosure of Your Information

 We do not sell, rent, trade, or otherwise disclose your personal information to third parties for their own commercial purposes. We may share information only in the following limited circumstances:

We engage third-party vendors to assist in operating the Service. These vendors may access your information only to perform services on our behalf and are contractually bound to protect it and not use it for any independent purpose. The vendors we engage and the services they provide may change over time as the Service evolves.

6.2 Legal Obligations

We may disclose information when required by applicable law, regulation, court order, subpoena, or other lawful legal process. Where legally permitted, we will make reasonable efforts to notify you before complying.

The specific measures we employ are calibrated to the sensitivity of the information processed and may evolve over time as technology and best practices change.

No method of electronic transmission or storage is completely secure. We cannot guarantee absolute security, and we disclaim liability for unauthorized access or disclosure that is beyond our reasonable control.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any suspected unauthorized use at security@easymedop.com.

We will notify you of a confirmed data breach affecting your personal information as required by applicable law.

8. Data Retention

We retain your information for as long as your account is active and for such additional period as is necessary to fulfill the purposes described in this Policy, comply with legal obligations, resolve disputes, and enforce our agreements.

The specific retention periods that apply to different categories of information may vary and are subject to change based on legal requirements, business needs, and the evolution of the Service. When data is no longer required for any legitimate purpose, we delete or anonymize it using industry-standard methods.

You may request deletion of your account and data at any time (see Section 10). Note that certain information may be retained after deletion where required by law or for legitimate business purposes such as fraud prevention, legal defense, or financial record-keeping.

9. Cookies and Tracking Technologies

We may use cookies, local storage, and similar technologies to operate and improve the Service. The specific technologies we use and their purposes may change as the Service evolves.

We do not use advertising cookies or technologies designed to track you across third-party websites for commercial purposes.

Depending on your jurisdiction, you may have certain rights regarding your personal information. Regardless of location, we honor the following rights for all users:

11. California Privacy Rights (CCPA / CPRA)

 If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), including the right to know, delete, correct, and opt out of the sale or sharing of personal information.We do not sell or share personal information as defined under California law.To submit a verifiable consumer request, contact us at privacy@easymedop.com. You may designate an authorized agent to make a request on your behalf.


12. Users Outside the United States

The Service is operated from the United States. If you access the Service from outside the United States, your information may be transferred to and processed in the United States, which may have data protection laws that differ from those in your jurisdiction.By using the Service, you consent to the transfer and processing of your information in the United States and in any other country where we or our service providers operate. We take appropriate measures to ensure such transfers comply with applicable law.


13. Children's Privacy

The Service is intended for adults and is not directed at individuals under the age of 18. We do not knowingly collect personal information from minors. If we become aware that a minor has submitted information to us, we will promptly delete it. If you believe a minor's information has been submitted, contact us at privacy@easymedop.com.

We are not responsible for the privacy practices of third parties and encourage you to review their privacy policies independently.The availability and nature of third-party integrations may change over time as the Service evolves.

We reserve the right to update or modify this Policy at any time to reflect changes in our practices, the Service, applicable law, or for other operational or legal reasons.For material changes, we will provide at least 14 days' advance notice by email or prominent notice within the Service. Non-material changes may be made without prior notice.Your continued use of the Service after the effective date of any revision constitutes your acceptance of the updated Policy. If you do not agree, you must stop using the Service and may request account deletion.Prior versions of this Policy are available upon written request.


16. Disclaimer of Warranties

THE SERVICE AND ALL RELATED DATA PROCESSING ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MEDOP ASSIST™ EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AS WELL AS ANY WARRANTIES REGARDING THE SECURITY, ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY INFORMATION PROCESSED OR STORED THROUGH THE SERVICE.


17. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MEDOP ASSIST™, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND ARISING OUT OF OR RELATED TO THIS POLICY, THE PROCESSING OF YOUR INFORMATION, OR ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THIS POLICY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).


18. Indemnification

You agree to indemnify, defend, and hold harmless MedOp Assist™, its officers, directors, employees, contractors, agents, licensors, and successors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) User Content you submit; (c) your violation of this Policy or our Terms of Service; or (d) your violation of any rights of a third party.


19. Governing Law and Dispute Resolution

This Policy shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to conflict of law principles. Any dispute arising out of or related to this Policy shall be subject to the exclusive jurisdiction of the state and federal courts located in [Your County, Your State], and you consent to personal jurisdiction in those courts.


20. Severability

If any provision of this Policy is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.


21. Entire Agreement

This Policy, together with our Terms of Service and any other agreements expressly incorporated by reference, constitutes the entire agreement between you and MedOp Assist™ regarding the subject matter herein and supersedes all prior or contemporaneous agreements, representations, or understandings.
